N. Decommissioning (1 ) A decommissioning plan shall be submitted as part of the land development application and shall identify all structures and improvements to be removed and the method of site restoration. a. The decommissioning plan shall include an estimated cost of site remediation compiled by a third party and reviewed by the county engineer for approval. (2) The property owner shall be responsible for removal of structures and restoration of the site to a safe and stable condition. (3) Financial security shall be provided in an amount not less than one hundred twenty-five percent (125%) of the estimated cost of decommissioning, as prepared by a qualified professional. a. Financial security shall be provided in a form acceptable to the county including but not limited to performance bonds, irrevocable letter of credit, escrow or other approved security. b. The estimate and financial security shall be reviewed and updated at least every five (5) years. c. The County shall retain the right to enforce decommissioning, recover costs, and pursue legal remedies as permitted by law. d. The property owner shall maintain any insurance required by applicable law and shall provide documentation upon request.
